Security firm Finjan has filed several motions against Secure Computing in an
attempt to prevent its rival from selling products ruled to have infringed on
certain Finjan patents.
Earlier this month, a jury found that Secure Computing and two of its
affiliates, Cyberguard and Webwasher, had "wilfully" infringed three Finjan
patents in the US.
Based on the trial win, Finjan requested that the court issue a permanent
injunction preventing Secure Computing from continuing to sell the infringing
products.
Finjan is also seeking enhanced damages up to three times the amount awarded
by the jury, as well as attorneys' fees, court costs and pre- and post-judgment
interest.
The jury awarded Finjan past damages of a 16 per cent royalty rate for
Webwasher software, eight per cent for Webwasher appliances and eight per cent
for Cyberguard TSP appliances.
The total amount of past damages based on information available to the jury
($49m worth of software and $16.75m worth of hardware) totalled $9.18m.
However, the damages did not include sales of Webwasher products after 9
September 2007, and sales of Cyberguard TSP appliances after June 2006, Finjan
said.
